Avanti Bhati and team were retained by an international financial institution to conduct asset identification for approximately 20 personal guarantors in the Middle East. The client was considering acquiring a portfolio of non-performing assets (NPAs) from a consortium of lenders, with each NPA representing corporate interests backed by personal guarantees extended by high-net-worth individuals. Prior to acquisition, the client sought to ascertain the extent of disclosed and identifiable wealth held by these guarantors to assess recovery prospects.
Evaluate
Our enquiries adopted a two-step approach combining comprehensive desktop research with discreet source intelligence. We mapped the guarantors' disclosed corporate interests and extracted details from public records, including their public profiles and business holdings. In parallel, we conducted discreet source enquiries to assess each guarantor's financial position and their willingness to negotiate settlement of the NPAs. Our investigation revealed varying levels of asset transparency across the guarantors, with some maintaining substantial undisclosed holdings in multiple jurisdictions.
Communicate
Osborne Partners provided the client with detailed asset profiles for each guarantor, including identified corporate holdings, real estate interests, and other material assets. Our report also included assessments of each individual's negotiating posture and likelihood of voluntary settlement, enabling the client to make informed decisions regarding the NPA acquisition and subsequent recovery strategy. The comprehensive profiles allowed the client to structure appropriate negotiation approaches for each guarantor.
